Blubbl provides software and infrastructure for building, managing, and operating online stores, websites, digital commerce experiences, marketing campaigns, content management systems, and related business operations.

Services may include:

  • Ecommerce storefronts
  • Content management tools
  • Product and inventory management
  • Marketing automation
  • Email campaign management
  • AI-powered content generation
  • Analytics and reporting
  • Payment integrations
  • API access
  • Customer management tools
  • Third-party integrations

Certain features may be modified, added, suspended, or discontinued at any time.

3. Eligibility

You must be at least 18 years old to create an account or use the Services.

By using the Services, you represent and warrant that:

  • You are at least 18 years old.
  • You have the authority to enter into these Terms.
  • All information provided is accurate and complete.
  • Your use of the Services complies with applicable laws.

4. Account Registration

To access certain features, you must create an account.

You agree to:

  • Provide accurate information.
  • Keep your information up to date.
  • Maintain the confidentiality of your credentials.
  • Notify us immediately of unauthorized access.

You are responsible for all activities occurring under your account.

Blubbl is not liable for losses resulting from unauthorized use of your credentials.

5. Authentication Services

Authentication may be provided through:

  • Email and password
  • Google
  • Apple
  • Facebook
  • Microsoft

Blubbl may also offer multi-factor authentication and additional security measures.

You are responsible for maintaining access to your authentication methods.

6. Subscription Plans and Fees

Use of the Services may require payment of:

  • Subscription fees
  • Usage-based fees
  • Transaction fees
  • AI feature fees
  • Optional add-on fees

Fees are described on our pricing pages and may be updated periodically.

Unless otherwise stated:

  • Fees are billed in advance.
  • Fees are non-refundable.
  • Taxes are charged where required by law.

7. Payment Providers

Merchants may connect third-party payment providers.

Supported providers may include:

  • Stripe
  • myPOS
  • iyzico
  • Additional providers introduced in the future

Blubbl may collect platform transaction fees through provider integrations or alternative billing mechanisms depending on the selected payment provider.

Merchants authorize Blubbl to collect agreed platform fees according to the selected pricing plan and connected payment provider configuration.

8. Merchant Responsibilities

Merchants are solely responsible for:

  • Products offered for sale
  • Pricing
  • Taxes
  • Shipping
  • Fulfillment
  • Refunds
  • Customer support
  • Marketing activities
  • Store content
  • Compliance with applicable laws

Merchants are responsible for maintaining appropriate policies including:

  • Privacy policies
  • Cookie policies
  • Refund policies
  • Terms and conditions

Merchants remain solely responsible for their relationships with customers.

9. Customer Data

Merchants acknowledge that:

  • They act as Data Controllers regarding customer information.
  • Blubbl generally acts as a Data Processor.

Merchants are responsible for ensuring they have lawful authority to collect and process customer information.

10. Email Services

Blubbl may provide transactional and marketing email functionality.

Merchants are responsible for:

  • Obtaining required consent
  • Maintaining subscriber lists
  • Complying with anti-spam laws
  • Managing unsubscribe requests

Blubbl reserves the right to suspend email functionality that results in abuse, excessive complaints, spam activity, or reputational harm.

11. AI Features

Blubbl may provide AI-powered functionality including:

  • Content generation
  • Product descriptions
  • Marketing copy
  • Image generation
  • Store building assistance
  • Content management assistance

AI-generated content may be inaccurate, incomplete, or inappropriate.

Users remain solely responsible for reviewing and validating all AI-generated content before publication or use.

Blubbl makes no guarantees regarding the accuracy of AI-generated outputs.

12. Acceptable Use

You agree not to:

  • Violate applicable laws
  • Infringe intellectual property rights
  • Distribute malware
  • Engage in fraud
  • Interfere with platform security
  • Circumvent platform restrictions
  • Reverse engineer platform functionality except where permitted by law
  • Access systems without authorization

13. Prohibited Businesses and Activities

The Services may not be used for:

  • Illegal products or services
  • Counterfeit goods
  • Weapons or weapon accessories
  • Adult content
  • Gambling services
  • Pyramid schemes
  • Fraudulent activities
  • Money laundering
  • Sanctioned entities
  • Activities prohibited by applicable laws

Blubbl reserves the right to suspend or terminate accounts engaged in prohibited activities.

14. Intellectual Property

Blubbl and its licensors retain all rights, title, and interest in the Services.

These Terms do not transfer ownership of:

  • Software
  • Trademarks
  • Branding
  • Documentation
  • Platform technology

Users retain ownership of content they upload to the Services.

You grant Blubbl a limited license to host, process, transmit, and display uploaded content solely for providing the Services.

15. Third-Party Services

The Services may integrate with third-party providers.

Examples include:

  • Payment providers
  • Analytics providers
  • AI providers
  • Email providers
  • Authentication providers

Blubbl is not responsible for the products, services, policies, or actions of third-party providers.

Use of third-party services may be subject to separate terms.

16. Availability

Blubbl strives to maintain reliable Services but does not guarantee uninterrupted availability.

The Services may experience:

  • Scheduled maintenance
  • Emergency maintenance
  • Downtime
  • Network interruptions
  • Third-party service disruptions

No uptime guarantee exists unless explicitly stated in a separate written agreement.

17. Beta Features

Certain features may be designated as beta, preview, experimental, or early access.

Such features may:

  • Contain defects
  • Be modified without notice
  • Be discontinued at any time

Beta features are provided "as is."

18. Suspension and Termination

Blubbl may suspend or terminate access if:

  • Fees remain unpaid
  • These Terms are violated
  • Fraud is suspected
  • Platform security is threatened
  • Required by law

Merchants may terminate their accounts at any time through available account management tools.

Termination does not relieve outstanding payment obligations.

19. Data Retention After Termination

Upon account deletion:

  • Access may be immediately disabled.
  • Data may remain recoverable for up to 30 days.
  • Production data may be permanently removed after the recovery period.
  • Backup copies may remain for up to 90 days before automatic deletion.

Certain information may be retained when required by law.

20. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUBBL DISCLAIMS ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY
  • RELIABILITY
  • AVAILABILITY

BLUBBL DOES NOT GUARANTEE THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUBBL SHALL NOT BE LIABLE FOR:

  • LOST PROFITS
  • LOST REVENUE
  • LOST DATA
  • BUSINESS INTERRUPTION
  • INDIRECT DAMAGES
  • CONSEQUENTIAL DAMAGES
  • SPECIAL DAMAGES
  • INCIDENTAL DAMAGES

BLUBBL'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY THE CUSTOMER TO BLUBBL DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

22. Indemnification

You agree to indemnify and hold harmless Blubbl, its officers, employees, contractors, and affiliates from claims arising out of:

  • Your use of the Services
  • Your content
  • Your products
  • Your violations of law
  • Your violations of these Terms

23. Force Majeure

Blubbl shall not be liable for delays or failures caused by events beyond reasonable control, including:

  • Natural disasters
  • Internet outages
  • Cyberattacks
  • Government actions
  • Labor disputes
  • Utility failures

24. Changes to These Terms

Blubbl may modify these Terms from time to time.

Updated Terms will be published on the website with a revised effective date.

Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

25. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to conflict of law principles.
